Position Description:
· The administrative law judge (ALJ) functions in a highly professional setting similar to a private law office. The ALJ works semi-autonomously while acting collegially with fellow ALJs. The ALJ coordinates with case management. The ALJ must exercise the necessary decorum and project the level of professionalism to cultivate respect for the Office's administrative tribunals similar to the judicial courts. The ALJ is responsible for managing a demanding caseload of hearings across a wide spectrum of subject matter for multiple state agencies, boards and commissions (agencies) requiring knowledge of the various and relevant state and federal statutes and administrative codes for those multiple agencies. The ALJ must prepare and issue timely orders and administrative decisions within statutory guidelines and Office policy. Decisions will have the potential to be final agency actions. The ALJ must complete special assignments as directed by the Director/Chief Presiding Administrative Law Judge or Assistant Presiding Administrative Law Judge. The ALJ must observe substantive and procedural policies of the Office. Please note that this ALJ position is "as needed" and hours will vary based on case volume.
Skills Required:
· The Administrative Law Judge (ALJ) must exercise proper decorum and project the necessary professionalism to cultivate respect for the Office's administrative tribunals. The ALJ must have word processing skills and work effectively with the OAH automated office system. The ALJ must be able to work semi-autonomously while acting collegially with fellow ALJs. The ALJ must be able to coordinate well with the case management supervisor, the executive assistants, and the case management team. The ALJ must possess the skills necessary to preside over administrative hearings involving represented and unrepresented parties; develop the record, rule on objections, and admit relevant evidence; be able to analyze and appraise facts and apply legal principles and precedents to complicated data; and make concise findings of fact, well-reasoned conclusions of law, and decisions which can act as final agency actions. The ALJ must possess knowledge of law necessary to track legal requirements and precedent which impinge on the Office’s mission; must possess refined skills in legal research; and must be self-motivated, able to work under changing conditions, with little need for rigid guidelines. The ALJ must possess legal research skills and be able to properly apply statutes, case law, established principles, conceptual models, professional standards, and precedents related to cases to resolve disputed issues. The ALJ must be able to apply judgment and resourcefulness in interpreting statutes, rules, regulation and general policy that may be ambiguous, conflicting or unclear, and apply precedent that may be incomplete, inadequate, or relevant only through approximation or by analogy. The ALJ must possess oral communication skills to include the ability to mediate disputes, issue oral rulings and directives, resolve disputes and authorize action with a high degree of professionalism, originality, and creativeness. The ALJ must possess excellent written communication skills to include the ability to prepare letters and orders and to draft decisions or recommendations that are clear, concise, and understandable to the Client person, yet follow the required format of findings of fact and conclusions of law.
Experience Required:
· Minimum requirements: graduate of accredited law school and five years of legal experience. Must be a member in good standing of any state bar.
